How to Legally Terminate a Land Lease Agreement with an Unscrupulous Tenant?

Terminating a land lease agreement is possible both by mutual consent of the parties and through judicial procedure if the tenant substantially violates the terms of the agreement or legal requirements. This was reported by lawyer Dina Dryzhakova.

 

The most common reasons are:

• systematic non-payment of rent;
• use of the land plot for purposes other than intended;
• deterioration of the land plot;
• other significant breaches of the contract.

Before going to court, it is recommended to send a written demand to the tenant specifying the specific violations and proposing to rectify them or voluntarily terminate the agreement.

If the tenant ignores the demand, the landowner can apply to the court with a claim for termination of the agreement. At the same time, the plaintiff must prove the fact of the contract breach, so it is important to gather proper evidence in advance: documents on non-payment of rent, inspection reports, correspondence, photographs, expert opinions, and other documents.

The practice of the Supreme Court is consistent: systematic failure by the tenant to fulfill their main obligations, especially regarding rent payment, may be sufficient grounds for early termination of the land lease agreement.
